हरियाणा व उत्तर प्रदेश सहित अनेक राज्यों में में आंदोलनकारियों द्वारा रोड व रेलवे ट्रेक जाम की बढ़ती प्रवृत्ति से गुस्साए सुप्रीम कोर्ट ने कड़ा रुख अपनाते हुए कहा है कि अपनी मांगें मनवाने के लिए आम नागरिक के मौलिक अधिकार छीनने का हक किसी को नहीं है। कोर्ट ने साफ कहा कि भविष्य में राज्य सरकारों को इस तरह की हरकतों से होने वाले नुकसान की भरपाई करनी होगी।

more... से 14 से 25 जनवरी तक जींद व हिसार में रेल व सड़क मार्ग जाम करने के मामले की सुनवाई के दौरान की।
खंडपीठ ने कहा कि वह रेल व सड़कें जाम करने की प्रवृति पर प्रभावी अंकुश लगाने के लिए दिशा-निर्देश जारी करना चाहती है और मिर्चपुर मामले में राज्य सरकार, रेलवे के अलावा सभी प्रतिवादी तीन सप्ताह के भीतर इसके लिए अपने सुझाव दें। कोर्ट ने कहा कि प्रस्तावित दिशा निर्देशों में इस तरह की गतिविधियों के लिए जवाबदेही तय की जाएगी क्योंकि कानून को हाथ में लेने की अनुमति किसी को नहीं दी जा सकती।
न्यायमूर्ति गांगुली का रुख तो सुनवाई के दौरान खासा कड़ा रहा और एकबारगी तो उन्होंने हरियाणा सरकार को रेलवे के 35 लाख रुपए के नुकसान की भरपाई का आदेश दे ही दिया था। इस पर राज्य सरकार की ओर से कहा गया कि नुकसान के दावों के निपटारे के लिए क्लेम आयुक्त की नियुक्ति की जा चुकी है। जब गांगुली ने राज्य सरकार से जाम रोकने के लिए उठाए गए कदमों की जानकारी मांगी तो प्रदेश के महाधिवक्ता ने कहा कि कड़े कदम उठाने पर हालात खराब हो सकते थे। इस बीच सुनवाई में हस्तक्षेप करते हुए न्यायमूर्ति सिंघवी ने कहा कि कोर्ट की मंशा भविष्य में इस तरह की घटनाओं की पुनरावृत्ति रोकने की है और इसके लिए सभी पक्षों को तीन सप्ताह में अपने सुझाव देने होंगे।
